These Terms of Service (“Terms”) govern your access to and use of americansubmission.com and any products or services offered by American Submission LLC (“American Submission,” “we,” “us,” or “our”).
By visiting our website, placing an order, creating an account, or otherwise using our services, you agree to these Terms.
If you do not agree to these Terms, please do not use our website or services.
1. Online Store
Our online store is operated using Shopify’s ecommerce platform.
You may use our website only for lawful purposes and in accordance with these Terms.
If you are under the age of majority where you live, you may use the website only with the involvement or permission of a parent or legal guardian.
You may not use our website to:
- violate any applicable law;
- commit fraud;
- transmit malicious software;
- interfere with website security;
- scrape or misuse website content;
- infringe intellectual-property rights; or
- engage in abusive, deceptive, or unauthorized activity.
We may restrict or terminate access to our website when reasonably necessary to protect our business, customers, or systems.
2. Products
We sell combat-sports apparel and related merchandise, including Brazilian Jiu Jitsu, no-gi, rash guard, training-short, and lifestyle products.
We make reasonable efforts to display product photographs, colors, descriptions, dimensions, and other product information accurately.
However, colors and appearance may vary depending on lighting, photography, screens, devices, manufacturing tolerances, or other factors.
Product availability is not guaranteed. Certain products, sizes, colors, or releases may be limited and may sell out without notice.
3. Pricing
Prices are displayed in U.S. dollars unless otherwise stated.
Prices, promotions, discounts, and product availability may change without notice.
We reserve the right to correct typographical, pricing, inventory, or product-description errors. If a material error affects an order you placed, we may contact you before fulfillment or cancel and refund the affected transaction where appropriate.
4. Orders
Submitting an order does not guarantee acceptance.
We may refuse, limit, or cancel an order when reasonably necessary, including in situations involving:
- suspected fraud;
- payment authorization problems;
- pricing or inventory errors;
- resale or commercial purchasing patterns;
- shipping restrictions;
- inaccurate customer information; or
- violations of these Terms.
If we cancel an order after payment has been collected, the applicable amount will be refunded as appropriate.
You are responsible for providing accurate billing, shipping, contact, and payment information.
5. Shipping
Orders are generally processed within 1–3 business days, excluding weekends and holidays.
Standard U.S. delivery generally takes approximately 3–7 business days after the carrier receives the package, although carrier delays and other circumstances outside our control may affect delivery.
We currently offer free standard U.S. shipping on orders of $60 or more.
International shipping times, duties, taxes, customs charges, and import requirements vary by destination.

6. Order Changes and Cancellations
If you need to modify or cancel an order, contact us as soon as possible.
We will make reasonable efforts to accommodate the request before fulfillment begins, but changes or cancellations cannot be guaranteed once an order is being processed or has shipped.
Once an order has shipped, it cannot ordinarily be canceled.
7. Returns, Exchanges, and Refunds
Eligible products may be returned within 14 days of delivery when they are:
- unworn;
- unwashed;
- unused;
- in original condition; and
- returned with original tags or packaging when applicable.
Eligible exchanges may also be requested within 14 days of delivery.
Damaged, defective, or incorrect items should be reported within 7 days of delivery.
Custom, personalized, or made-to-order products may be final sale unless they arrive damaged, defective, or incorrect.
All returns and exchanges remain subject to our current Refund, Return & Exchange Policy, which is incorporated into these Terms.

8. Promotions and Discount Codes
Discounts, promotions, giveaways, affiliate codes, and special offers may be subject to additional restrictions.
Unless expressly stated otherwise:
- promotions have no cash value;
- promotions may not be combined;
- discounts may not apply retroactively;
- promotional availability may be limited; and
- we may modify or discontinue a promotion to the extent permitted by law.
9. Intellectual Property
The website and its content, including American Submission names, logos, graphics, product artwork, photographs, text, designs, apparel graphics, videos, and other materials, are owned by or licensed to American Submission and are protected by applicable intellectual-property laws.
You may use the website for personal, non-commercial shopping purposes.
You may not copy, reproduce, modify, distribute, sell, create derivative works from, or commercially exploit our content without written authorization.
Nothing in these Terms grants you ownership of any American Submission trademark, copyright, design, or other intellectual property.
10. Reviews, Photos, and User Content
If you submit a review, photograph, comment, testimonial, social-media tag, or other content directly to us, you represent that:
- you have the right to submit it;
- it does not infringe another person’s rights;
- it is not unlawful, fraudulent, defamatory, threatening, or malicious; and
- it does not contain malware or harmful code.
If you expressly submit content for publication on our website or marketing channels, you grant American Submission a non-exclusive, worldwide, royalty-free license to reproduce, display, distribute, and use that submitted content in connection with our business and marketing, subject to applicable law.
We may remove user content that violates these Terms.
11. Third-Party Services and Links
Our website may use or link to services provided by Shopify, payment providers, social-media platforms, shipping companies, analytics providers, and other third parties.
Those third parties operate under their own terms and privacy policies.
To the extent permitted by law, American Submission is not responsible for third-party websites or services outside our control.

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms.
13. Website Availability
We attempt to provide reliable access to our website, but we do not guarantee uninterrupted, secure, or error-free operation.
We may modify, suspend, maintain, restrict, or discontinue all or part of the website when reasonably necessary.
14. Disclaimer of Warranties
To the maximum extent permitted by applicable law, our website and its content are provided on an “as is” and “as available” basis.
Nothing in these Terms excludes any warranty, protection, or consumer right that cannot legally be excluded.
15. Limitation of Liability
To the fullest extent permitted by applicable law, American Submission LLC and its owners, officers, employees, contractors, affiliates, service providers, and agents will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or connected with use of the website or products.
Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms is intended to waive any legal right that cannot lawfully be waived.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless American Submission LLC from third-party claims, liabilities, losses, or reasonable expenses resulting from your unlawful use of the website, violation of these Terms, or infringement of another party’s rights.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
18. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
To the extent permitted by applicable law, disputes relating to these Terms or our services will be handled in an appropriate state or federal court located in Clark County, Nevada.
Nothing in this section deprives a consumer of any non-waivable rights or protections provided by applicable law.
20. Changes to These Terms
We may revise these Terms periodically.
Changes will become effective when the revised Terms are posted to our website unless another effective date is stated.
Your continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.
21. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, Refund/Return/Exchange Policy, and other policies expressly incorporated by reference, constitute the agreement governing use of our online store.
